Terms of Service

These terms of service (“Terms of Service”) set forth the terms and conditions that apply to your use of the PsychedelicLaw.ca website, located at https://www.psychedeliclaw.ca (“Site”), and any and all affiliated websites, webpages, email newsletters, social media channels and/or accounts (the Site, affiliated websites, servers, social media channels and/or accounts, collectively, the “Platforms”). Green Economy Law Professional Corporation (“GELPC”), which runs the Site and the Platforms, may change these Terms of Service from time to time, at GELPC’s sole discretion, without notice to you, so we encourage you to check for updates each time you visit or use the Platforms to review the then-current terms. Your continued use of the Site and the Platforms signifies your acceptance of these Terms of Service.

GENERAL TERMS

Use of the Platforms is restricted to your personal use and you shall not use the Platforms for any other purpose.

These Terms of Service herein and our Privacy Policy contain the entire agreement between you and GELPC relating to your use of the Platforms, and supersede all prior or concurrent communications and proposals, in any form, between you and GELPC. If a different policy is provided on a third-party site, application or service which hosts a Platform, such different policy shall govern and control the relationship between you and such third-party site, application or service.

The Site and the Platforms are not intended for persons under the age of 13 and GELPC does not knowingly collect personal information from children in this age group.

INTELLECTUAL PROPERTY

GELPC owns (or has the right to use) all content on the Platforms and all intellectual property rights therein, and all such content is protected under copyright law.

GELPC and its brands, and any current or future affiliated or related companies and brands (collectively, “Affiliates”), trademarks and design marks (collectively, the "Marks"), are trademarks or registered trademarks of GELPC and/or its Affiliates, and the property thereof. All other product, brand and company names and logos used, displayed or referenced on the Platforms may be the trademarks or registered trademarks of their respective owners. Any use of any trademarks, including the Marks, without the express written consent of the owner of the trademark is strictly prohibited.

DISCLAIMER

The information on the Platforms is provided "as is" and without warranties or conditions of any kind, either express or implied. GELPC specifically disclaims all warranties and conditions of any kind including, but not limited to, all implied warranties and conditions of merchantability, fitness for a particular purpose, title and non-infringement. No information presented on the Site or the Platforms is to be considered legal, medical, financial or investing advice. If you would like to obtain legal advice from GELPC personnel, please contact us directly to set up a consultation for the purposes of obtaining such.

Content on the Sites and the Platforms may cover subjects such as prohibited substances and narcotics. GELPC does not endorse, encourage, support, or otherwise condone illegal use, consumption, sale of, or other activities involving psychedelic or any other narcotic substances.

We do not warrant that the content, including information, on the Site or the Platforms (including any information, images, photos, video, material or downloadable content accessed from or through the platforms) will be accurate, uninterrupted or free of errors, defects, viruses or other harmful components, that viruses or errors will be corrected, or that the sites or servers upon which they reside are free from viruses or any other harmful components.

UNDER NO CIRCUMSTANCES, INCLUDING BUT NOT LIMITED TO NEGLIGENCE, SHALL GELPC, ITS PARENTS, AFFILIATES, SUBSIDIARIES, AGENTS, DIRECTORS, OFFICERS, EMPLOYEES, REPRESENTATIVES, SUCCESSORS, LICENSORS OR ASSIGNS BE LIABLE TO YOU OR ANY THIRD PERSON FOR DAMAGES OF ANY KIND, WHETHER BASED IN TORT, CONTRACT, STRICT LIABILITY OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES EVEN IF GELPC HAS BEEN ADVISED SPECIFICALLY OF THE POSSIBILITY OF SUCH DAMAGES, ARISING IN ANY WAY FROM OR IN CONNECTION WITH THIS SITE, THE PLATFORMS, USE OF OR INABILITY TO USE THE PLATFORMS OR ANY LINKS OR ITEMS THEREIN OR ANY PROVISION OF THE TERMS OF SERVICE, SUCH AS, BUT NOT LIMITED TO, LOSS OF REVENUE OR ANTICIPATED PROFITS OR LOST BUSINESS.

INDEMNITY

By using the Platforms, you agree to indemnify and hold GELPC (including its directors, directors, agents, affiliates, employees, representatives, successors, assigns, and third party service providers) harmless from any and all claims, demands, losses, liabilities and damages (actual and consequential) of any kind or nature, known and unknown, including legal fees, arising out of or in connection with your use of the Platforms, including but not limited to any violation by you of the Terms of Service, any law or the rights of any third party.

ANTI-SPAM

We do not use the Platforms to disseminate spam. E-mail messages sent in connection with the Platforms, such as the GELPC email newsletter, are only sent to those who have provided express or implied consent therefor and will contain an “unsubscribe” link.

GOVERNING LAW

The Site and the Platforms are controlled and operated by GELPC from Toronto, Ontario, Canada. You agree that your use of the Platforms is governed by the laws of the Province of Ontario and the federal laws of Canada without giving effect to any principles of conflict of law. You agree that any dispute, difference, controversy or claim between us or by either of us against the other or the employees, agents, mandataries, officers, directors, successors, assigns or affiliates of the other, arising out of, relating to, or having any connection with, the present terms, the Platforms, any use of the Platforms and any transaction conducted on or from it (whether contractual or extra-contractual, in contract or tort, pursuant to statute or regulation, or otherwise, and whether pre-existing, present or future), including any question regarding negotiation, formation, existence, validity, performance, effects, interpretation, breach, resolution or annulment and further including the applicability or scope of this clause shall be brought exclusively in a court of competent jurisdiction in Toronto, Ontario, Canada.

We have made all reasonable attempts to comply with all legal requirements known to us in creating and maintaining the Platforms, but make no representation that any materials or content on the Platforms are necessarily acceptable, appropriate or available in any jurisdiction. If you choose to access the Platforms from any location other than Canada, you do so of your own volition and you are solely responsible for complying with any applicable local laws. If any part of these Terms of Service are invalid or unenforceable for any reason whatsoever under applicable law, the invalid or unenforceable provision shall be deemed severable from these Terms of Service and shall not affect the validity or enforceability of any remaining provisions.

INJUNCTIVE AND PROVISIONAL RELIEF

GELPC shall have the right to seek and obtain any injunctive, provisional or interim relief from any court of competent jurisdiction to protect its trademark or other intellectual property rights or confidential information.

CONSENT TO USE ELECTRONIC DOCUMENTS

You hereby consent to the exchange of information and documents between you and GELPC over the Internet or by e-mail, and that any such agreement in electronic form shall be the equivalent of an original written paper agreement between us. You further agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
